CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: <br />TO: <br />FROM: <br />SUBJECT: <br />October 15, 1996 <br />Wandzia Grycz, Interim City Manager <br />Joann Oliver, Community Standards Coordinator <br />APPROVED AND FORWARDED <br />TO CITY COUNCIL <br />k Q�i� - <br />Wandzia z <br />Interim CiIaL� <br />Appeal Revocation of Conditional Use Permit for C & G Contractors, Inc. <br />CU-93-14 <br />SUMMARY AND RECOMMENDATION <br />On August 1, 1996, a public hearing was held before the Board of Zoning Adjustments to modify <br />or revoke the Conditional Use Permit for C & G Contractors, Inc. located at 2660 Eden Road. <br />After hearing all testimony, the Board of Zoning Adjustments acted to revoke the permit for failure <br />to comply with the Conditions of Approval. The business owner, Mr. Jerry Guss, appealed the <br />revocation to the City Council. <br />Board of Zoning Adjustments Vote: <br />The motion was made by Board Member Padro and carried as follows: <br />(4 ayes)(2 absent)(1 vacancy) to revoke CU-93-14. <br />Staff recommends that the City Council uphold the Board of Zoning Adjustments' action and deny <br />the appeal based on the following finding: <br />C & G Contractor's, located at 2660 Eden Road, is currently operating in violation of <br />the terms and conditions of Conditional Use Permit CU-93-14 and the San Leandro <br />Municipal Code Chapter 12, Title VII, regarding Grading, Excavations and Fills. <br />BACKGROUND <br />In early 1995, it came to the City's attention that C & G Contractors appeared to exceed the <br />limitations established in the Conditional Use Permit. The Use Permit authorizes the recycling of <br />concrete and asphalt through the processing of the material into two foot by two foot size pieces for <br />removal for further processing at another location. The approved plot plan identifies four <br />distinctive piles on the site for: concrete, asphalt and concrete, clean fill and a shipping area. The <br />plan shows piles that are 15 feet high and 40 feet in diameter. Access around each pile, as well as <br />access to all parking and the building, is identified. <br />11 <br />
