CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: October 28, 1996 <br />TO: Wandzia Grycz, Interim City Manager <br />APPROVED AND FORWARDED <br />TO CITY COUNCIL <br />FROM: June Catalano, Development Services Director�I <br />BY: Debbie Potter, Redevelopment Administrator 0 <br />SUBJECT: Approval of Resolutions of Necessity for Acquisition of Easements in <br />Conjunction with Marina Boulevard Auto Mall Project <br />SUMMARY AND RECOMMENDATION <br />On October 7, 1996, the City Council and Redevelopment Agency directed staff to prepare <br />Resolutions of Necessity for acquisition of easements in conjunction with the Marina Boulevard <br />Auto Mall Project. To develop the 1152 Marina Boulevard property as required by Nissan for <br />their dealership, an existing access easement that benefits 2094 and 2088 Wayne Avenue must be <br />extinguished and a new non-exclusive access easement at 2000 Wayne Avenue must be acquired. <br />The Resolutions of Necessity are attached for Council and Agency action. <br />It is recommended that the City Council and Redevelopment Agency conduct a property owner <br />hearing and that, following the hearing, the City Council: <br />• Approve a Resolution Determining that the Public Interest and Necessity Require the <br />Acquisition of an Easement in Certain Land and Directing the Filing of Eminent Domain <br />Proceedings (2000 Wayne Avenue). <br />And that the Redevelopment Agency: <br />• Approve a Resolution Determining that the Public Interest and Necessity Require the <br />Acquisition of Certain Land and Directing the Filing of Eminent Domain Proceedings <br />(Extinguishes easement at 1152 Marina that benefits properties at 2088 and 2094 Wayne <br />Avenue). <br />BACKGROUND <br />As part of the Marina Boulevard Auto Mall Project, the Redevelopment Agency acquired the <br />property located at 1152 Marina Boulevard. The property, which will be sold to the Batarse <br />Family Trust, will house the Nissan dealership. The original plans prepared by the developer <br />called for the reuse of the existing building. However, when Nissan reviewed the plans, it <br />required that the existing building be torn down and that a new showroom and office tha <br />79' <br />
