District Agreement No. 4-1653-C <br />of IMPROVEMENTS. Soundwall construction plans shall be approved <br />by STATE. CITY shall complete soundwall. replacement by <br />November30, 1996, and shall coordinte construction of soundwall <br />with STATE's construction of PROJECT. CITY shall allow STATE's <br />contractor to bid on construction of soundwall replacement, and <br />may accept said bid if it is the lowest among all cotractor's <br />bidding for CITY soundwall replacement project, and said bid is <br />in conformance with CITY award policies. If CITY does not com- <br />plete soundwall replacement by aforementioned completion date, <br />STATE may, at its sole discretion, award and construct soundwall <br />replacement project. If STATE awards and constructs soundwall re- <br />placement project, STATE shall bill CITY one hundred percent <br />(100%) cost of construction plus sixteen percent (16%) for con- <br />struction engineering. CITY shall pay STATE's invoices within 20 <br />days. <br />(9) To transfer to STATE all rights -of -way necessary to <br />relocate portions of soundwall described in Section II, Article <br />(10) To perform all right of way activities including <br />all eminent domain activities, if necessary, at no cost to STATE, <br />in accordance with procedures acceptable to STATE, and in compli- <br />ance with all applicable State and Federal laws and regulations, <br />subject to STATE oversight to insure that the completed work is <br />acceptable for incorporation into the State highway right of way. <br />(11) To utilize the services of a qualified puplic <br />agency in all right of way acquisition related matters in accord- <br />
