IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 96 - 23 (280 3) <br />RESOLUTION CERTIFYING NEGATIVE DECLARATION <br />FOR THE WESTGATE PARKWAY PROJECT <br />Recitals <br />1. An Initial Study for the Westgate Parkway Project, (the "project") was concluded. <br />2. Notice of preparation of a Negative Declaration was provided by publication and <br />posting pursuant to San Leandro Administrative Code Sec. 28.1.240(b). <br />3. Comments were received during the public review process and a response to <br />comments sections was included in the Negative Declaration. <br />4. A Negative Declaration for the Westgate Parkway Project has been presented to <br />the Council. The City Council has reviewed and considered the Negative Declaration, a <br />copy of which is attached hereto as Exhibit A, and finds that the Negative Declaration has <br />been completed in conformance with the California Environmental Quality Act (CEQA), <br />the State EIR Guidelines and the City of San Leandro EIR Guidelines and that there is no <br />substantial evidence that the project will have a significant effect on the environment. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />That the Negative Declaration for the project be certified as completed in compliance <br />with CEQA, the State EIR Guidelines and the City of San Leandro EIR Guidelines. <br />
