B. BORROWER will report to the CITY in writing of BORROWER'S placement needs <br />for each and every covered position by providing the following information: <br />1. job description, including minimum qualifications, stated in objective terms. <br />2. Number of employees to be hired by job title. <br />3. Work to be performed. <br />4. Hiring date of each position. <br />5. Rate of pay for each position. <br />6. Work hours. <br />7. Anticipated duration of employment. <br />8. Residency. <br />C. BORROWER agrees to maintain and provide CITY, upon CITY'S request, with <br />documentation of the steps it has taken to fulfill the obligations imposed by this <br />Agreement. Such documentation will indicate the following information: <br />1. The number and types of covered positions created or retained by BORROWER <br />during the term of this Agreement. <br />A description of the recruitment and hiring process used for each such covered <br />position, including but not limited to an identification of the total number of low <br />income persons considered and/or interviewed for each such position. <br />For each such covered position, whether or not such position was filled by a low <br />income person or if such position was not filled by a low income person, the <br />reasons for rejection of any low person considered by the BORROWER or any <br />other applicable reason for BORROWER'S inability to fill such position by hiring <br />a low income person. <br />4. Such additional information as may be reasonably requested by CITY. <br />CITY will monitor BORROWER'S job retention compliance with this Agreement <br />during the term of this Agreement. BORROWER agrees to cooperate with CITY in <br />responding to CITY'S requests for information deemed necessary by CITY to monitor <br />BORROWER'S compliance, including but not limited to BORROWER'S provision of <br />annual hiring summaries to CITY, in a form acceptable to CITY. <br />VI. CONTROLLING REGULATIONS AND LAW. <br />A. This Agreement shall be subject to the laws of the State of California, applicable <br />labor laws and governmental regulations. In the event of conflict, this Agreement <br />shall be construed, if possible, in harmony with applicable law in order to eliminate <br />the conflict. <br />B. BORROWER agree not to discriminate against any applicant for employment due to <br />the applicant's race, religion, age, color, sex, sexual orientation, national origin, <br />physical handicap, disability or political affiliation. <br />CDBG Employment Agreement EXHIBIT D <br />Page 4 of 7 <br />
