<br />REGULATORY AGREEMENT
<br />THE BORROWER, Michael H. Wiesner and Kathy Greenstone-Sherman, hereby assures and
<br />certifies that he or she will comply with all regulations, policies, guidelines, and requirements as
<br />they relate to the CITY OF SAN LEANDRO SMALL BUSINESS LOAN FUND. Also the BORROWER
<br />assures and certifies that:
<br />BORROWER shall not discriminate against any employee or applicant for employment
<br />because of race, color, religion, sex, sexual orientation, human immunodeficiency virus
<br />status, national origin, age, marital status, familial status, disability or handicap. BORROWER
<br />shall make every effort to insure that applicants for employment are employed and
<br />employees are treated during employment, without regard to their race, color, religion, sex,
<br />sexual orientation, human immunodeficiency virus status, national origin, age, marital status,
<br />familial status, disability or handicap. Such action shall include, but not be limited to, the
<br />following: employment, upgrading, demotion, or transfer; recruitment or recruitment
<br />advertising; layoff or termination; rates of pay or other forms of compensation; and selection
<br />for training, including apprenticeship. BORROWER shall post in conspicuous places,
<br />available to employees and applicants for employment, notices to be provided by the
<br />Government setting forth the provisions of this nondiscrimination clause. BORROWER shall
<br />include with all applicable notices that all qualified applicants will receive consideration for
<br />employment without regard to race, color, religion, sex, sexual orientation, human
<br />immunodeficiency virus status, national origin, age, marital status, familial status, disability
<br />or handicap.
<br />2. BORROWER will comply with Title VI of the Civil Rights Act of 1964 (42-U.S.C. §2000d)
<br />prohibiting employment discrimination where 1) the primary purpose of the financial
<br />assistance is to provide employment, or 2) discriminatory employment practices will result
<br />in unequal treatment of persons who are or should be benefiting from the loan -aided
<br />activities.
<br />BORROWER will comply with the Section 112 of Public Law 92-65 and Title III of Public
<br />Law 94-135 whereby the BORROWER assures that no person in the United States shall on
<br />the grounds of sex or of age be excluded from participating in, be denied the benefits of, or
<br />otherwise be subject to discrimination in connection with loan -aided activities.
<br />4. BORROWER will comply with the flood insurance purchase requirement of Section 102(a)
<br />of the Flood Disaster Protection Act of 1973, Public Law 93-234, 87 Stat. 975, approved
<br />December 31, 1976. Section 102(a) requires, on and after March 2, 1975, the purchase of
<br />flood insurance in communities where such insurance is available as a condition for the
<br />receipt of any federal financial assistance for construction or acquisition purposes for use in
<br />any area that has been identified by the Secretary of the Department of Housing and Urban
<br />Development as an area having special flood hazards. The phrase "federal financial
<br />assistance" includes any form of loan, grant, or any other form of direct or indirect federal
<br />assistance.
