(f) all documents, models, graphics, correspondence, records, and copies of <br />minutes of nny meetings of governmental authorities used in or related to approvals <br />for entitlements for development of the Property; <br />(g) all plaris and specifications relating to any present or planned <br />improvements on the Property, including but not limited to, the plans and <br />specifications described on E.chibit B attached hereto and incorporated herein; <br />(h) anv architectural drawings and engineering, soils, seismic, and geologic <br />reports, studies and certificates pertaining to the Property which are owned by and <br />v,ithin the possession or control of JBN; and <br />(i) any other materials owned by J13N exclusively for use in connection ,Nith <br />the developmenc of the Property or the construction of improvements thereon. <br />Items transferred pursuant to subsections 1(a)- I (d) are collectively referred to <br />herein as the "Licenses and Permits." Items transferred pursuant to subsections I(e)- <br />I(i) are collectively refen-ed to herein as the Records and Plans." <br />2. RELEASE. JBN does hereby release, acquit and forever discharge the City <br />of San Leandro, as well as all agencies, employees and agents thereof, froin any and all <br />actions, causes of action, claims, demands, damages, costs, loss of services, expenses <br />and compensation, arising from or related to that certain Lease entitled Marina Hotel <br />Lease dated Junc 12, 1997. <br />3. SUCCESSORS. This Assignment shall be binding on and inure to the <br />benefit of the parties to it, their heirs, executors, administrators, successors in <br />interest, and assigns. <br />4. SEVERABILITY. If any tern or provision of this Assignment shall be held <br />invalid or unenforceable, or any Liccnsc, Pcrmit, Rccord or Plan be considered non - <br />assignable, the remainder of this Assignment shall not. be affec'red. <br />5. WrMVERS. No waiver or breach of any covenant or provision shall be <br />deemed a waiver of any other covenant or provision, and no waiver shall be valid <br />unless in writing and executed by the waiving party. <br />6.
