regulations at any time applicable thereto of any public or governmental authority, including the City of San Leandro, relating to sanitation or the public health, safety or welfare. Lessee shall not use any area outside of the hotel building for exhibits, shows or other group activities that involve the installation or erection of structures or equipment, deny the use of landscaped open area to the public or impair the use of vehicle parking or circulation on the leased premises without the prior written approval of Lessor. This prohibition, however, shall not be construed to prevent or preclude customary and appropriate hotel related activities and promotions. Lessee hereby expressly agrees to all times during the term of this lease, at its own cost and expense, to maintain and operate all building and site improvements on the demised premises in a clean, wholesome and sanitary condition, and Lessee shall, at its own cost and expense, at all times faithfully obey and comply with all laws, rules and regulations applicable thereto adopted by Federal, State of California, Local or other government bodies or departments or officers thereof, including without limitation, ordinances adopted by the Council. 5. RENTAL A. Minimum Rental Lessee shall, on or before the first day of each month, pay as a minimum rental for each of the first twelve (12) months or until such time as Lessee opens the leased premises for business, whichever is earlier, in advance without offset or previous demand, in lawful money of the United States of America, a minimum rental of FIVE THOUSAND FIVE HUNDRED DOLLARS ($5,500) per month. Lessee shall pay as a minimum rental for each of the first five (5) years during the term of this lease, in twelve (12) equal monthly installments, in advance without offset or previous demand, in lawful money of the United States of America, on the day Lessee opens the leased premises for business or on first day of the thirteenth (13) month following execution of this Lease by City and Lessee, whichever is earlier ("Date for Commencement of Payment of Rent"), and continuing thereafter on the first (1 st) day of each succeeding calendar month during the first five (5) years of the term of this lease, a minimum rental of ELEVEN THOUSAND DOLLARS ($11,000) per month. For each subsequent five (5) year period for the term of the lease, the minimum rental shall be seventy-five percent (75%) of the monthly average of percentage rental for the prior thirty-six (36) months.
