regulations at any time applicable thereto of any public or governmental authority, <br />including the City of San Leandro, relating to sanitation or the public health, safety <br />or welfare. <br />Lessee shall not use any area outside of the hotel building for exhibits, shows or other <br />group activities that involve the installation or erection of structures or equipment, <br />deny the use of landscaped open area to the public or impair the use of vehicle <br />parking or circulation on the leased premises without the prior written approval of <br />Lessor. This prohibition, however, shall not be construed to prevent or preclude <br />customary and appropriate hotel related activities and promotions. <br />Lessee hereby expressly agrees to all times during the term of this lease, at its own <br />cost and expense, to maintain and operate all building and site improvements on the <br />demised premises in a clean, wholesome and sanitary condition, and Lessee shall, at <br />its own cost and expense, at all times faithfully obey and comply with all laws, rules <br />and regulations applicable thereto adopted by Federal, State of California, Local or <br />other government bodies or departments or officers thereof, including without <br />limitation, ordinances adopted by the Council. <br />5. RENTAL <br />A. Minimum Rental <br />Lessee shall, on or before the first day of each month, pay as a minimum rental for <br />each of the first twelve (12) months or until such time as Lessee opens the leased <br />premises for business, whichever is earlier, in advance without offset or previous <br />demand, in lawful money of the United States of America, a minimum rental of FIVE <br />THOUSAND FIVE HUNDRED DOLLARS ($5,500) per month. <br />Lessee shall pay as a minimum rental for each of the first five (5) years during the <br />term of this lease, in twelve (12) equal monthly installments, in advance without <br />offset or previous demand, in lawful money of the United States of America, on the <br />day Lessee opens the leased premises for business or on first day of the thirteenth <br />(13) month following execution of this Lease by City and Lessee, whichever is earlier <br />("Date for Commencement of Payment of Rent"), and continuing thereafter on the <br />first (1 st) day of each succeeding calendar month during the first five (5) years of the <br />term of this lease, a minimum rental of ELEVEN THOUSAND DOLLARS ($11,000) <br />per month. <br />For each subsequent five (5) year period for the term of the lease, the minimum <br />rental shall be seventy-five percent (75%) of the monthly average of percentage rental <br />for the prior thirty-six (36) months.
