(2) The amount of money from Gross Receipts, deposited in said special bank <br />account, maintained in said certificates of deposit or expended pursuant to this <br />subsection. <br />Any portion of the minimum percentage amount to be expended for said renovation <br />and replacement for a Plan Year may be deferred and carried over into the next year if <br />permitted by the approved five-year plan or by the prior written consent of the City. <br />The obligations under this subsection are separate from and in addition to all of the <br />preceding obligations under this subsection. Lessee understands and agrees that, in <br />order to operate a first-class business, maintain the Improvements in a first-class <br />condition, and to provide up-to-date facilities of first-class order, periodic major <br />renovation and refurbishing of the Improvements is necessary. During the 25th year <br />of the term of this Lease (or such other time approved in writing by the City) Lessee <br />shall submit to the City for City approval a detailed plan for Lessee's major <br />renovation and refurbishing of the Improvements, which provides for the <br />commencement of work before expiration of the 25th year of the term of this Lease, <br />or such other date or dates as may be authorized in writing by the City. Within <br />ninety (90) days after receipt of said detailed plan of major renovation and <br />refurbishing the City shall approve, disapprove or request amendments to said plan, <br />and Lessee within thirty (30) days thereafter, as appropriate, shall submit to the City <br />a new or amended plan. The City shall approve or disapprove the new or amended <br />plan within sixty (60) days after Lessee's submittal. The City's approval shall not be <br />unreasonably withheld or delayed. After approval of the plan and necessary building <br />permits by the City, Lessee shall promptly secure all necessary permits and approvals <br />for the work and commence construction, and thereafter diligently complete the same <br />as provided in said City approved plan. <br />13. LESSEE'S CONDUCT OF BUSINESS - <br />OTHER OPERATIONS OF LESSEE <br />A. Lessee covenants and agrees that, continuously and uninterruptedly from and <br />after its initial opening for business, it will operate and conduct within the <br />premises the business which it is permitted to operate and conduct under the <br />provisions hereof, except while the premises are unusable Lease by reason of <br />fire or other casualty, and that it will at all times keep and maintain within and <br />upon the premises adequate inventory and supplies, personal property, and <br />trade fixtures, and adequate personnel to service and supply the usual and <br />ordinary demands and requirements of its customers and that it will keep its <br />premises in a neat, clean and orderly condition. Without limiting the <br />generality of the foregoing, Lessee agrees to remain open 24 hours a day, 365 <br />days a year. <br />B. Lessee will be subject to a mandatory injunction to compel the specific <br />performance of the provisions of this paragraph. It is agreed, however, that the <br />17 <br />
