EXHIBIT B <br />SCOPE OF DEVELOPMENT - GENERAL TERMS <br />1. USE OF PREMISES <br />The demised premises shall be used by Lessee for the construction and operation of a <br />first-class hotel for transient accommodations, interior courtyard, swimming pool, <br />tennis courts, parking, landscaped open space, vending of food and other uses <br />incidental thereto, except the providing of live entertainment. <br />2. IMPROVEMENTS <br />Lessee agrees to construct and operate a first class Marriott Residence Inn hotel <br />including parking, public access improvements and landscaping. Lessee further agrees <br />to renovate the off -site comporter dock, located in the Bay directly adjacent to the <br />westerly boundary of the site, as an observation pier. Lessee shall relocate to the <br />City's satisfaction public restrooms on the adjacent boat launching ramp. Lessee shall <br />rip rap the perimeter of the demised premises to the City's standards. All <br />improvements within the leased area shall be maintained by Lessee excepting any <br />repairs and maintenance in the public access area directly resulting from activities of <br />the City. Such repairs and maintenance of the public access area shall be the sole <br />responsibility of the City. The development drawings are attached hereto and made a <br />part hereof. Lessee shall construct all improvements in accordance with building and <br />zoning approvals granted by City. <br />Lessor shall maintain off -site improvements such as public roads, sidewalks, dikes, <br />parking facilities and related lighting, landscaping, drainage and irrigation. <br />3. DESIGN DRAWINGS -- PRELIMINARY PLANS <br />Design drawings showing the interior arrangement of the proposed hotel and the <br />exterior appearance of the hotel and the site (Preliminary Plans) shall be prepared and <br />submitted to the City. The Preliminary Plans shall include floor plans of each floor in <br />the proposed hotel buildings; a site plan showing proposed open areas, landscaping <br />treatment, parking, recreation facilities, public access areas and elevation of <br />perspective drawings adequate to clearly show the exterior appearance of all sides of <br />the proposed hotel buildings, all of which are adequate to permit the staff of the Bay <br />Marina Hotel Lease Exhibit B <br />
