WILLIAMS STREET STORM DRAINAGE <br />SYSTEM AGREEMENT <br />This AGREEMENT ("Agreement") is between the CITY OF SAN LEANDRO <br />("City"), and GOLDEN GATE SEAFOOD, INC., ("Golden Gate Seafood") and is dated for <br />the convenience of the parties this 1st day of February, 1996. <br />RECITALS <br />1. Golden Gate Seafood operates at 1815 Williams Street ("Property"), City of <br />San Leandro, County of Alameda, State of California. <br />2. The storm drainage system at the Property is presently not linked with the <br />Alameda County Flood Control facility nor is it sufficient to meet the needs of Golden Gate <br />Seafood due to a limited capacity and regional topography. <br />3. By constructing a storm drainage connection from the present inlet at 1815 <br />Williams Street, through the Golden Gate Seafood property, through other adjoining private <br />property and to the Alameda County Flood Control facility on Merced Street, excess storm <br />water will also be properly channeled and removed from Williams Street. <br />4. By entering into this Agreement, the parties hereto express their mutual desire <br />to resolve the storm water drainage issue in a manner that is economically beneficial to both <br />City and Golden Gate Seafood. <br />AGREEMENT <br />In consideration of the promises and mutual covenants set forth herein and for other <br />good and valuable consideration, receipt of which is hereby acknowledged, the City and <br />Golden Gate Seafood agree as follows: <br />3991001\202005.4 <br />1 <br />
