Three Hundred Twenty -Four Dollars ($7,324). This represents a deposit of approximately <br />ten percent (10%) of thirty percent (30%) of the estimated total Project costs. The City's <br />current estimate of costs is reflected on Exhibit A, attached hereto. Exhibit A reflects an <br />estimate of total Project costs only, and Project expenditures shall be subject to review in <br />advance by the parties, as indicated in Section 6. The balance of Golden Gate Seafood's <br />thirty percent (30%) share of the costs shall be paid to City five (5) days prior to the City's <br />award of the contract. In the event that the amount paid by Golden Gate Seafood exceeds <br />thirty percent (30%) of actual total Project cost, the City shall promptly refund the difference <br />to Golden Gate Seafood upon conclusion of the Project and final accounting. In the event <br />that the estimated amount is insufficient to cover Golden Gate Seafood's obligation to pay <br />thirty percent (30%) of actual total Project cost, Golden Gate Seafood shall pay the additional <br />amount owed within thirty (30) days upon notice by the City. <br />4. Golden Gate Seafood shall dedicate to the City an easement for egress and <br />ingress across the Property for construction and maintenance of the Project. This easement <br />shall be in the form of Exhibit B, attached hereto and incorporated herein by reference. In <br />the event that the Project is terminated pursuant to Section 6, Golden Gate Seafood shall <br />have no obligation to dedicate the aforementioned easement and the City shall decline such <br />easement. City agrees to maintain the main line of the storm water drainage system, <br />including the portion that passes through and under the Golden Gate Seafood Property and <br />also including manholes (also referred to as structures or stubs). City will not maintain any <br />hook-ups or private lines extending from the main line, maintenance for which shall be <br />provided by the private property owners. <br />3991001\202005.4 3 <br />
