WHEREAS, the Agency has approved and transmitted to the City Council the Reuse <br />Report required by Health and Safety Code § 33433 by Agency Resolution No. 96- Io ; <br />WHEREAS, the City Council has received the Reuse Report required by Health and <br />Safety Code § 33433 and is familiar with the contents thereof; <br />WHEREAS, the Agency has held a properly noticed public hearing and taken all <br />other actions required by law to prepare and present the form of the Disposition and <br />Development Agreement, and the Reuse Report; <br />WHEREAS, the City Council does hereby take official notice of all documents, <br />surveys, records and reports maintained in the ordinary course of business by the Agency <br />and the City of San Leandro relating to the real properties which are the subject of the form <br />of the Disposition and Development Agreement and the Reuse Report, and the City Council <br />has considered the report and recommendations regarding the form of the Disposition and <br />Development Agreement and the Reuse Report, and has provided an opportunity for all <br />persons to be heard, and has received and considered all evidence and testimony presented <br />for or against any and all aspects of the form of the Disposition and Development <br />Agreement and the Reuse Report. <br />NOW THEREFORE, the City Council of the City of San Leandro does hereby <br />RESOLVE as follows: <br />1. That, pursuant to the California Health and Safety Code, the City Council makes the <br />following findings: <br />I. That the City Council finds that, on the basis of the following specific <br />findings, the sale of the property, which may be purchased in whole or in <br />part with tax increment revenues, set forth in the form of the Disposition and <br />Development Agreement between the Redevelopment Agency of the City of <br />San Leandro and the Batarse Family Trust, to the Batarse Family Trust will <br />assist in the elimination of blight in the County of Alameda - City of San <br />Leandro Joint Redevelopment Project Area. <br />(a) The assembling of parcels, removal/renovation of existing <br />improvements and construction of new automobile and used <br />automobile dealerships will help to eliminate and prevent the spread of <br />conditions of blight including deteriorating buildings, incompatible <br />land uses, uneconomic land uses, contaminated sites, and obsolete <br />structures by removing and replacing and/or renovating old and vacant <br />buildings with new automobile and used automobile dealerships. <br />(b) The sale of the property for the construction of the new automobile <br />and used automobile dealerships will create superior vehicular and <br />F4 <br />
