MAILING ADDRESS: 14200 Chapman Rd <br />San Leandro, CA 94578 <br />LEASE TYPE: General Lease — Public Agency Use <br />LAND TYPE: Sovereign <br />LOCATION: San Francisco Bay, near City of San Leandro, as described in Exhibit A <br />attached and by this reference made a part hereof. <br />LAND USE OR PURPOSE: Use and maintenance of restored marshlands habitat, water circulation <br />and drainage system, pedestrian and emergency vehicle access bridge as a component of the San <br />Francisco Bay Trail, tide gates, and a pedestrian bridge. <br />TERM: 25 years; beginning February 25, 2022; ending February 24, 2047, unless sooner terminated <br />as provided under this Lease. <br />CONSIDERATION: The public use and benefit, with the Lessor reserving the right at any time to <br />set a monetary rent if the Lessor finds such action to be in the State's best interest or as specified in <br />Paragraph 3(c) of Section 3 - General Provisions. <br />AUTHORIZED IMPROVEMENTS: <br />X_ EXISTING: Restored marshlands habitat, water circulation and drainage system, pedestrian and <br />emergency vehicle access bridge as components of the San Francisco Bay Trail, tide gates, and a <br />pedestrian bridge. <br />LIABILITY INSURANCE: $2,000,000 <br />SURETY BOND OR OTHER SECURITY: $0 <br />SECTION 2 <br />SPECIAL PROVISIONS <br />BEFORE THE EXECUTION OF THIS LEASE, ITS PROVISIONS ARE AMENDED, <br />REVISED, OR SUPPLEMENTED AS FOLLOWS: <br />Lessee acknowledges that the land described in Exhibit A of this Lease is subject to the Public <br />Trust and is presently available to members of the public for recreational, waterborne commerce, <br />navigation, fisheries, open space, and any other recognized Public Trust uses. Lessee also agrees <br />that Lessee's authorized activities and use of the Lease Premises shall not unreasonably interfere <br />with or limit Public Trust rights and shall do so only to the extent necessary to protect public <br />health and safety during activities authorized by Lessor, or when imminent threats to public health <br />and safety are present. <br />
