C. That Assessment District No. 96-3 shall provide for the maintenance of <br />various public improvements within and adjacent to the Heron Bay development, said <br />public improvements to include: the Shoreline Trail and buffer area; tidal marshlands <br />commonly known as Citation Marsh, North Marsh, East Marsh, and Bunker Marsh; a <br />storm water lift station and two treatment ponds; and certain public street improvements; <br />all as shown on Exhibit A, attached hereto. <br />D. That, for the purposes of Assessment District No. 96-3, the term <br />maintenance shall include all activities related to the purchase, construction, installation, <br />operation, repair, upkeep, supplies, appurtenances and services for said public <br />improvements, and administration of said District. <br />E. That the boundaries of the proposed Assessment District No. 96-3 are <br />shown on that certain map entitled 'Proposed Boundary for Heron Bay Maintenance <br />Assessment District, Assessment District No. 96-3," said map being on file in the Office <br />of the City Clerk. <br />F. That the Director of Engineering and Transportation is hereby authorized <br />to direct NYSTROM ENGINEERING CORPORATION, as Engineer for these <br />formation proceedings, to prepare and file with this Council the Engineer's Report for <br />Assessment District No. 96-3 in accordance with the provisions of Section 2-5-405 of the <br />San Leandro Municipal Code. <br />
