FINAL <br />CONDITIONS OF APPROVAL <br />PLN21-0045 —12929 Neptune Drive <br />Perry Gastis (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />1. The applicant/property owner shall comply with Exhibits A and B, date received February <br />16, 2022 except as hereinafter modified. <br />Exhibit A — Proposed Site Plan <br />Exhibit B — Proposed Fence Elevation <br />2. The applicant/property owner shall be responsible for assuring that any successor in interest <br />who assumes responsibility for this zoning approval is informed of its terms and conditions. <br />3. This Fence Modification allows for the establishment of a six-foot tall metal fence and <br />gate to encroach 10 feet and 20 feet, respectively into the 20-foot required front yard <br />where three feet is the maximum fence height allowed, at 12929 Neptune Drive, zoned <br />RO Residential Outer; Alameda County Assessor's Parcel Number 79A-560-3-1. <br />II. GENERAL CONDITIONS <br />4. The fence shall be structurally sound and well maintained at all times; any damage to the <br />fence or gate shall be promptly repaired. <br />5. Any graffiti on the property shall be promptly removed. <br />6. No ribbon or barbed wire shall be installed on the fencing. <br />7. Construction of the project shall remain in substantial compliance with the approved <br />exhibits and plans. Any change to the project design or materials shall be subject to the <br />review and approval of the Zoning Enforcement Official. <br />8. The approvals granted by the City as a result of this application, as well as the Conditions <br />of Approval, shall be recorded in the office of the County Recorder of Alameda County. <br />9. No application for amendment of the application or Conditions of Approval may be <br />accepted or submitted for processing by the City unless (i) there is full compliance with <br />all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director can waive compliance with the terms of the application if they are <br />minor in content. <br />Draft Conditions of Approval March 15, 2022 <br />PLN21-0045 Page 1 of 2 <br />
