FINAL CONDITIONS OF APPROVAL PLN21-0045 —12929 Neptune Drive Perry Gastis (Applicant and Property Owner) I. COMPLIANCE WITH APPROVED PLANS 1. The applicant/property owner shall comply with Exhibits A and B, date received February 16, 2022 except as hereinafter modified. Exhibit A — Proposed Site Plan Exhibit B — Proposed Fence Elevation 2. The applicant/property owner shall be responsible for assuring that any successor in interest who assumes responsibility for this zoning approval is informed of its terms and conditions. 3. This Fence Modification allows for the establishment of a six-foot tall metal fence and gate to encroach 10 feet and 20 feet, respectively into the 20-foot required front yard where three feet is the maximum fence height allowed, at 12929 Neptune Drive, zoned RO Residential Outer; Alameda County Assessor's Parcel Number 79A-560-3-1. II. GENERAL CONDITIONS 4. The fence shall be structurally sound and well maintained at all times; any damage to the fence or gate shall be promptly repaired. 5. Any graffiti on the property shall be promptly removed. 6. No ribbon or barbed wire shall be installed on the fencing. 7. Construction of the project shall remain in substantial compliance with the approved exhibits and plans. Any change to the project design or materials shall be subject to the review and approval of the Zoning Enforcement Official. 8. The approvals granted by the City as a result of this application, as well as the Conditions of Approval, shall be recorded in the office of the County Recorder of Alameda County. 9. No application for amendment of the application or Conditions of Approval may be accepted or submitted for processing by the City unless (i) there is full compliance with all terms of the application and Conditions of Approval; or (ii) the Community Development Director can waive compliance with the terms of the application if they are minor in content.
