Brown (Applicant and Property Owner) <br />THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br />corporation, hereinafter referred to as "City," and Glenn R. Brown, hereinafter referred to as <br />"Applicant" and "Property Owner." <br />Applicant applied for and received a Major View Preservation / Residential Site Plan Review <br />approval for a Height Exception (PLN21-0019), approved on December 2nd, 2021, to build a second - <br />story addition of approximately 490 square feet, at a height of 23 feet, 11 inches at 1833 Hillview <br />Drive. Per Zoning Code Section 2.04.412(C)(1), the Board of Zoning Adjustments is "authorized <br />to grant Exceptions to the height limits of the RS-VP Sub -District, up to a height not to exceed the <br />30 feet height limit of the base RS District." Zoning District: RS-VP (Single -Family Residential <br />View Preservation); Alameda County Assessor's Parcel Number (APN): 079-0026-086-00. <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is mutually <br />agreed as follows: <br />1. Applicant and/or Property Owner agrees to comply with the Conditions of Approval adopted <br />by the City of San Leandro Board of Zoning Adjustments, more specifically described in the <br />list of Conditions of Approval, attached hereto, and as described in the exhibits on file in the <br />Community Development Department, all of which are incorporated herein by this reference. <br />2. This agreement shall be binding upon and inure to the benefit of the parties hereto and their <br />respective heirs, successors, and assigns. <br />3. City is authorized to record this agreement and any amendments thereto with the Alameda <br />County Recorder, California. All amendments hereto must be in writing and signed by the <br />appropriate authorities of the City and Applicant and/or Property Owner.
