The Developer shall present a DDA to the Agency with terms and conditions and in a <br />form acceptable to the Agency within the option period and prior to the Agency <br />conveyance of the land. <br />Presuming that the above two conditions are met, and subject to the specific terms and conditions <br />stated in the Agreement: <br />1. The Developer may exercise the Option with 150 days of the Agreement. The option <br />price of $25,000 will be credited toward the purchase price. <br />2. The Developer shall apply for and diligently pursue all necessary Agency and City <br />permits and licenses required to authorize the use, construction and operations of the <br />Property as a fast food restaurant and automobile service station. <br />3. The Developer shall develop appropriate curb cuts, returns and entry drives which may <br />be approved as a part of the specific site plan. <br />4_ The Developer must ensure that the improvements to the subject property are <br />constructed, used and maintained in accordance with the provision of the Plaza Il <br />Redevelopment Plan and within the time frame specified within the DDA. <br />5. Developer will pay all title insurance premiums, and one-half of the conveyance and <br />transfer taxes, recording fees and escrow fee. <br />6.
