IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 96 - 89 (2813 ) RESOLUTION APPOINTING ENGINEER, ATTORNEYS AND PLACEMENT AGENT WITH RESPECT TO THE CITY OF SAN LEANDRO SEISMIC RETROFIT ASSESSMENT DISTRICT NO. 96-2 Recitals WHEREAS, the owners of the certain parcels of real property within the City of San Leandro have petitioned the City Council to undertake special assessment proceedings and to issue assessment bonds for certain proposed acquisitions and improvements with respect to said properties; and WHEREAS, Chapter 12 of Title II of the San Leandro Municipal Code (the "Code") and the statutes of the State of California provide that the City Council may undertake such special assessment proceedings and issue such assessment bonds; NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: Section 1. Assessment Proceedings Intended. This Council wishes to undertake proceedings pursuant to the Code and to the appropriate assessment and assessment bond acts for the acquisition and construction of public and private improvements, and the public interest and convenience will be served by appointing and employing certain consultants, as specified herein, for the preparation and conduct of said proceedings; and Section 2. Engineer of Work. The firm of Nystrom Engineering is appointed as Engineer of Work and employed to do and perform all engineering work necessary in and for said proceedings, including the preparation of the requisite plans, specifications, maps and descriptions of easements, estimate of costs, diagram and assessment, all as set forth in an Agreement for Engineering Services, a copy of which is on file with the City Clerk. The Mayor, the City Manager or the Finance Director is hereby authorized and directed in the name and on behalf of the City to execute said Agreement.
