IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 96 -1a2 (2698 ) <br />RESOLUTION AMENDING THE <br />JOINT EXERCISE OF POWERS AGREEMENT FOR THE <br />ALAMEDA COUNTY ABANDONED VEHICLE <br />ABATEMENT PROGRAM <br />RECITALS <br />WHEREAS, Assembly Bill 4114 (Clute and Bently) became law as of January <br />1, 1991, allowing a majority of the Cities and the County of Alameda to establish <br />county wide service authority for the abatement of abandoned vehicles; and <br />WHEREAS, by resolutions and a Joint Powers Agreement, all of the Cities of <br />Alameda County and the County of Alameda itself established the Alameda County <br />Abandoned Vehicle Abatement Authority pursuant to the statutes and the Guidelines <br />of the California Highway Patrol, effective June 1, 1993; and <br />WHEREAS, abandoned vehicles continue to be a blight upon the land, <br />offending aesthetic sensibilities, harboring inimical insects and other health <br />threatening creatures, posing a health and safety hazard, and allowing valuable <br />resources to be wasted; and <br />WHEREAS, due to the signing into law of AB 135 (Rains) and therefore <br />amendment of the statutes effective January 1, 1996, the existing Alameda County <br />Abandoned Vehicle Abatement Program must be amended for the program to <br />continue; and <br />WHEREAS, the City of San Leandro believes that the Alameda County <br />Abandoned Vehicle Abatement Program continues to benefit the populace of the <br />Cities and the entire County of Alameda and hereby endorses said Program; and <br />WHEREAS, the Amendment of Joint Exercise of Powers Agreement for <br />Abatement of Abandoned Vehicles, a copy of which is attached, makes the necessary <br />changes to bring the program into compliance Nvith current law; and <br />WHEREAS, the City Council is familiar with the contents thereof. <br />
