Pursuant to § 664 i :he Subdivision Map Act, the City <br />96116018 <br />in Leandro has, by <br />ordinance, imposed a requirement for the payment of fees in lieu of parkland dedication <br />upon proposed residential subdivisions. <br />The requirement for the payment of parkland in -lieu fees was made a condition of <br />the subdivision map approval for the subject project and the approval for (Tract Map No. <br />N/A ) Parcel Map No. 6978 was granted subject to such condition. <br />NOW, THEREFORE, in consideration of the granting of final subdivision approval <br />for Parcel Map No. 6978 , it is mutually agreed as follows: <br />1. Developer agrees to comply with all the conditions of approval as <br />more specifically described in the reports and exhibits on file in the office of the City <br />Clerk, attached hereto, incorporated herein by reference, and adopted by the City Council. <br />2. Developer agrees to pay to the City parkland in -lieu fees imposed <br />pursuant to § § 7-1-820 through 7-1-855 of the San Leandro Municipal Code of 1985. <br />3. City agrees that Developer may pay the parkland in -lieu fees in the <br />following matter: <br />(a) The total amount of the fee is $1,500.00 per unit. <br />(b) There are 3 dwelling units in Parcel Map No. 6978. <br />(c) Upon close of escrow between Developer and the subsequent <br />purchaser, Developer or any successor in interests of Developer <br />shall pay the full amount of the fee. <br />(d) If any fees due hereunder are unpaid by the end of the 5th <br />year from the date of recordation hereof, Developer or any <br />successor shall pay all fees due under the terms hereof. <br />FAMAPSTM6978TARKLAND.AGR Page 2 of 4 <br />
