subcontract upon a finding that the subcontractor is in violation of regulations <br />issued by the Secretary of Housing and Urban Development, 24 C.F.R. 135. <br />Contractor will not subcontract with any subcontractor where it has notice or <br />knowledge that the latter has been found in violation of regulations under 24 <br />C.F.R. 135 and will not let any subcontract unless the subcontractor has first <br />provided it with a preliminary statement of ability to comply with the re- <br />quirements of these regulations. <br />7. LEAD -BASED PAINT <br />Contractor agrees that all rehabilitation or construction of residential structures <br />with assistance provided under this contract shall be subject to HUD Lead -Based <br />Paint Regulations at 24 CFR 570.608, and 24 CFR Part 35, and in particular <br />Sub -Part B thereof. Such regulations pertain to all HUD -assisted housing and <br />require that all owners, prospective owners, and tenants of buildings constructed <br />prior to 1978 be properly notified that such properties may include lead -based <br />paint. Such notification shall point out the hazards of lead -based paint and <br />explain the symptoms, treatment and precautions that should be taken when <br />dealing with lead -based paint poisoning. <br />8. SECTION 504 - PROGRAM ACCESSIBILITY <br />A. General Prohibition Against Discrimination <br />No qualified individual with a handicap shall, solely on the basis of handicap, be <br />excluded from participation in, be denied the benefits of, or otherwise by subjected to <br />discrimination by a contractor receiving Federal assistance as part of the CDBG <br />program. <br />1. Specific Prohibitions Against Discrimination <br />A contractor who receives Federal assistance as part of the CDBG program, in <br />providing any service, benefit, aid or housing may not, directly or through <br />contractual, licensing, or other arrangements, solely on the basis of handicap: <br />(a) deny; (b) afford unequal treatment; (c) provide ineffective service, benefit, <br />aid or housing; (d) provide different service, benefit, aid or housing; or (e) limit <br />the enjoyment of any right, privilege, or advantage, to a qualified individual with <br />handicaps the opportunity to participate in, or benefit from, the service, benefit, <br />aid or housing; <br />Exhibit E <br />Page 6 of 7 <br />
