4. On June 3, 1996, at the time and place for which notice was given, the City <br />Council conducted the first public hearing to hear public testimony regarding the proposed <br />assessment district. <br />5. On June 17, 1996, at the time and place for which notice was given, the City <br />Council conducted a second public hearing and gave every interested person an <br />opportunity to object to the proposed Project, the extent of the assessment district, or the <br />proposed assessment, and any other aspect of the proposed assessment proceedings. <br />6. The City Council finds that no written protests were submitted by any owner <br />of the land to be assessed for the Project. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />A. The City Council approves the Engineer's Report and each component part of <br />it, including each exhibit incorporated by reference in the Report. Without limiting the <br />generality of the foregoing approval, the City Council hereby finds that Nystrom, in the <br />Engineer's Report, has fairly and properly apportioned the cost of the Project to each <br />parcel of land in the assessment district in proportion to the estimated benefits to be <br />received by each parcel, respectively, from the Project. <br />B. The City Council hereby confirms and levies each individual assessment as <br />stated in the Engineer's Report for 1996-97, and confirms that the maximum individual <br />assessments for subsequent years may be increased by up to, but not to exceed, two <br />percent (2%) each successive year over the rate of the previous year. <br />C. The City Council hereby orders the implementation of the maintenance <br />activities described in the Engineer's Report, and particularly Exhibit A thereof. <br />D.
