IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 96 - 121 (2813 ) RESOLUTION ADOPTING ENGINEER'S REPORT, CONFIRMING THE ASSESSMENT, ORDERING THE WORK AND ACQUISITIONS AND DIRECTING ACTIONS WITH RESPECT THERETO SEISMIC RETROFIT ASSESSMENT DISTRICT NO. 96-2 Recitals WHEREAS, on June 3, 1996, this Council adopted Resolution No. 96-90, A Resolution of Intention to Make Acquisitions and Improvements, and in it directed the Engineer of Work to make and file a report in writing in accordance with and pursuant to the Municipal Improvement Act of 1913 and the San Leandro Municipal Code (together, the "Act"); WHEREAS, the report of the Engineer of Work was made and filed, and considered by this Council and found to be sufficient in every particular, whereupon it was determined that the report should stand as the Engineer's Report for all subsequent proceedings under and pursuant to the Resolution of Intention, and June 17, 1996, and August 5 1996, at the hours of 8:00 and 7:00 o'clock p.m., respectively, in the Community Library Center, 300 Estudillo Avenue, Lecture Hall, San Leandro, California 94577, were appointed as the times and place for a meeting to take testimony and for a hearing to receive protests, in relation to the proposed acquisitions and improvements, notices of which meeting and hearing were mailed as required by law; and WHEREAS, at the appointed times and place the meeting and the hearing were held, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters and things pertaining to the acquisitions and improvements were fully heard and considered by this Council, and any protests, both written and oral, were duly heard, considered and overruled, and this Council thereby acquired jurisdiction to order the acquisitions and improvements and the confirmation of the diagram and assessment to pay the costs and expenses thereof;
