IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.96 - 122 (2813 ) <br />RESOLUTION AUTHORIZING THE ISSUANCE OF BONDS, APPROVING <br />AND DIRECTING THE EXECUTION OF A FISCAL AGENT AGREEMENT, <br />AUTHORIZING PURCHASE AND SALE OF BONDS AND APPROVING <br />OFFICIAL STATEMENT AND OTHER RELATED DOCUMENTS AND <br />ACTIONS WITH RESPECT THERETO <br />SEISMIC RETROFIT ASSESSMENT DISTRICT NO. 96-2 <br />Recitals <br />WHEREAS, this Council has conducted proceedings under and pursuant to Resolution of <br />Intention No. 96-90, adopted June 3, 1996 (the "Resolution of Intention"), to form the Seismic <br />Retrofit Assessment District No. 96-2 (the "District"), to authorize the levy of special assessment <br />upon the land within the District, and to issue bonds secured by said special assessment the <br />proceeds of which are to be used to finance the acquisition of certain improvements (the <br />"Improvements"), all as described therein; <br />WHEREAS, pursuant to the Resolution of Intention, this Council has provided for the <br />issuance of improvement bonds pursuant to the Improvement Bond Act of 1915, Division 10 of <br />the Streets and Highways Code of the State of California (the "Bond Law"); <br />WHEREAS, notice of recordation of the assessments and the right to have thirty (30) <br />days or any other period of time within which to pay assessment in cash has been duly waived <br />and there is on file with the Finance Director of the City a list of all the assessments which <br />remain unpaid (the "List of Unpaid Assessments"); <br />WHEREAS, there have been submitted to this Council certain documents providing for <br />the issuance of the bonds by the City for the District, including the forms of Fiscal Agent <br />Agreement, Bond Purchase Offer, and Preliminary Official Statement, and this Council, with the <br />aid of its staff, has reviewed said documents and said Preliminary Official Statement to assure <br />
