The project is a public use, to wit: provision of street lighting service. <br />38. The public interest and necessity require this project. <br />39. The project is planned and located in a manner that will be most compatible with the <br />greatest public good and least private injury. <br />40. The property sought in this action is necessary for the project. <br />41. The amount of just compensation for the property being condemned, including <br />compensation for all future uses to which San Leandro may put the property pursuant to the rights <br />obtained in this action, together with all costs and litigation expenses, if any, to which PG&E may be <br />entitled, and including interest, shall be $651,224.41, less the deposit of $283,206.00 (previously <br />withdrawn by PG&E). This net sum shall accrue interest commencing January 5, 1998 to the date of <br />payment at the rate of $56.29 per day until paid. <br />42. The parties have waived their rights to appeal from this judgment. <br />G. Union City. <br />43. Union City is a municipal corporation and is authorized by Section 37350.5 of the <br />Government Code to condemn for the purposes of the project described in the complaint. <br />44. The project is a public use, to wit: provision of street lighting service. <br />45. The public interest and necessity require this project. <br />46. The project is planned and located in a manner that will be most compatible with the <br />greatest public good and least private injury. <br />47. The property sought in this action is necessary for the project. <br />48. The amount of just compensation for the property being condemned, including <br />compensation for all future uses to which Union City may put the property pursuant to the rights obtained <br />in this action, together with all costs and litigation expenses, if any, to which PG&E may be entitled, and <br />including interest, shall be $940,449.09, less the deposit of $232,985.00 (previously withdrawn by <br />PG&E). This net sum shall accrue interest commencing January 5, 1998 to the date of payment at the <br />rate of $108.21 per day until paid. <br />5 <br />
