4. The Agency has concluded that the Developer has the necessary <br />expertise, skill and ability to carry out the commitments herein contained and that <br />this Agreement is in the best interests and will materially contribute to the <br />Redevelopment Plan. <br />AGREED: <br />PART ONE: PROJECT <br />Article One: DEVELOPER'S PRE -DISPOSITION REQUIREMENTS <br />1.01 Conditions Precedent. <br />As a condition precedent to the Agency's obligation to sell and convey to <br />Developer the portions of the Property acquired by the Agency and Developer's <br />commencement of construction, the conditions set forth in this Article One must first <br />be met by the date as set forth in this Part relevant for such condition, unless such <br />time limit is extended by the Agency or at the discretion of its Executive Director. <br />1.02 ADnroval of Development Plan. <br />Prior to the execution of this Agreement, the Developer duly submitted to the <br />Agency a Preliminary Development Plan for the development of the Property. By <br />execution of this Agreement the Agency hereby approves said Plan. The Preliminary <br />Development Plan calls for the development of new and used automobile dealerships <br />at 1066-1072 Marina Boulevard and 1152 Marina Boulevard, and the construction <br />of certain improvements to the Property in connection therewith (referred to herein <br />as the "Improvements"). <br />1.03 Final Development Plan. <br />Developer shall submit to the Agency a Final Development Plan for the <br />Improvements. The Final Development Plan shall be substantially consistent with <br />the Preliminary Development Plan and the Redevelopment Plan and shall set forth in <br />drawings and models and/or elevations, size and location of buildings, the number <br />and location of parking spaces, the specific treatment and location of all landscaping <br />amenities, the location of all pedestrian and automobile ingress and egress points, the <br />Disposition and Development Page 2 of 39 <br />Agreement (Automall) <br />10/2/96 <br />
