IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 96-167 (1120 ) <br />RESOLUTION OF THE SAN LEANDRO CITY COUNCIL APPROVING <br />THE FINAL DISPOSITION AND DEVELOPMENT AGREEMENT <br />BETWEEN THE BATARSE FAMILY TRUST AND <br />THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />Recitals <br />WHEREAS, the City Council previously approved the form of the Disposition <br />and Development Agreement ("Agreement") <br />Redevelopment Agency ("Agency") and the <br />15, 1996, by Resolution No. 96- 62 ; and <br />between the San Leandro <br />Batarse Family Trust ("Batarse") on April <br />WHEREAS, the parties to the Agreement have finalized their negotiations and <br />addressed all contingencies so that a final Agreement could be prepared; and <br />WHEREAS; the Agreement continues to provide that the Agency may acquire <br />real property parcels in the County of Alameda - City of San Leandro Joint <br />Redevelopment Project Area ("Joint Project Area") Project area, which acquisition <br />may be in whole or in part, directly or indirectly financed with tax increment money, <br />and convey those parcels to Batarse, who shall then build and operate an automall on <br />Marina Boulevard ("Automall"); and <br />WHEREAS, the Agreement continues to place additional restrictions, <br />covenants and conditions on Batarse regarding the building and operation of several <br />automobile dealerships forming the Automall, as well as a sales tax generation <br />guaranty; and <br />WHEREAS, the City Council previously approved the report required by <br />Health and Safety Code § 33433 ("Reuse Report") which contained a summary of the <br />Agreement, and the final version of this Agreement does not modify the analysis of <br />the Reuse Report. <br />NOW THEREFORE, the City Council of the City of San Leandro does hereby <br />RESOLVE as follows: <br />
