PURPOSE: The purpose of the loan ("Loan") evidenced by <br />this Promissory Note ("Note") is to provide financing to <br />be used by BORROWER in the acquisition and rehabilitation <br />of certain real property, currently known as Fargo <br />Gardens apartment complex, located at 650 through 740 <br />Fargo Avenue in the City of San Leandro, California. <br />2. SOURCE OF LOAN: The City of San Leandro has received the <br />sum of $300,000 for use in Affordable Housing activities <br />by virtue of being a participating member of the Alameda <br />County HOME Consortium. HOME funds are provided by the <br />Department of Housing and Urban Development (HUD) and <br />contain certain restrictions for use of the funds. <br />3. SECURITY: This Note is secured by a Subordinate Deed of <br />Trust executed by Fenway Partners, in favor of the City <br />of San Leandro. <br />4. TERMS OF PAYMENT: <br />a. The term of this Note is from the date of execution <br />by the BORROWER for a period of fifteen (15) years. <br />- 1 - <br />
