EXHIBIT E <br />GENERAL FEDERAL/STATE CONDITIONS <br />1. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may be funded by <br />fiscal assistance from another governmental entity, Recipient shall comply with all applicable rules <br />and regulations to which City is bound by the terms of such fiscal assistance program. In <br />particular, Recipient agrees to comply with all applicable provisions of the Housing and <br />Community Development Act of 1974 (Public Law 93-383) and regulations promulgated pursuant <br />thereto. <br />2. RECORDS. Records must be kept accurate and up-to-date. Recipient's records shall be <br />made available for review by the City, HUD or the designee. Recipient shall be responsible to <br />maintain, for not less than three (3) years after completion of this Agreement, all records <br />pertaining to this Agreement, including subcontracts and expenditures, and all other financial and <br />property records. <br />A. Recipient shall at any time during normal business hours and as often as the City, HUD <br />and the Comptroller General of the United States may deem necessary, make available to their <br />representatives for examination all of Recipient's records with respect to all matters covered by <br />this Agreement and shall permit these representatives to audit, examine and make excerpts or <br />transcripts from such records, and to make audits of all documents and conditions relating to this <br />Agreement. All costs are subject to the eligibility requirements of HUD. <br />B. Recipient shall permit and facilitate observation and inspection of the work and records <br />at Recipient's principal office and job site by City, its employees and public authorities during <br />reasonable business hours. <br />E1114-1911M Mall <br />A. Recipient certifies that no member of, or delegate to the Congress of the United States shall <br />be permitted to share, or take part in this Agreement or in any benefit arising therefrom. <br />B. Recipient certifies that no member, officer, or employee of the City of San Leandro, or <br />its designees or agents, no member of the San Leandro City Council, and no other public official <br />of the City of San Leandro who exercises any functions or responsibilities with respect to the <br />CDBG program during its tenure or for one year thereafter, shall have any interest, direct or <br />indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in <br />connection with this Agreement. <br />
