2. During the performance of this Agreement, Recipient agrees as follows: <br />a. Recipient will not discriminate against any employee or applicant for employment <br />because of race, color, religion, sex, sexual orientation, handicap, age, or national <br />origin. Recipient will take affirmative action to ensure that applicants for <br />employment are employed, and that employees are treated during employment, <br />without regard to their race, color, religion, handicap, sex, sexual orientation, age, <br />or national origin. Such action shall include but not be limited to the following: <br />employment; upgrading; demotion or transfer; recruitment or recruitment <br />advertising; layoff or termination; rates of pay or other forms of compensation; and <br />selection from training, including apprenticeship. <br />Recipient will incorporate the above Affirmative Action provisions in all <br />consultants for services covered by this Agreement. <br />1. In connection with the performance of this Agreement, Recipient shall comply with the <br />City and Federal Governments' current policies and use its best efforts to obtain the <br />maximum utilization of minority -owned business enterprises based in San Leandro and <br />ensure that minority and female -owned enterprises based in San Leandro shall have <br />maximum practicable opportunity for subcontractor work under this Agreement. <br />2. General prohibitions against employment discrimination. <br />a) No qualified individual with a handicap or a disability shall, solely on the basis of <br />such handicap or disability, be subjected to discrimination in employment by a <br />contractor receiving Federal financial assistance. <br />b) The contractor may not limit, segregate, or classify applicants or employees in any <br />way that adversely affects their opportunities or status because of handicap or <br />disability. <br />c) Prohibition against discrimination in employment by the contractor applies to the <br />following activities: recruitment, advertising, processing of applications for <br />employment; hiring, upgrading, promotion, award of tenure, demotion, transfer, <br />layoff, termination, right of return from layoff, injury or illness, and rehiring; <br />rates of pay or any other form of compensation and changes of compensation; job <br />assignments, job classifications, organizational structures, position descriptions, <br />lines of progression, and seniority lists; leaves of absence, sick leave, or any other <br />
