IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 97- 28 (1206/1- 311 q) <br />RESOLUTION DETERMINING THAT THE PUBLIC <br />INTEREST AND NECESSITY REQUIRE THE ACQUISITION <br />OF EASEMENTS IN CERTAIN LAND AND DIRECTING <br />THE FILING OF EMINENT DOMAIN PROCEEDINGS <br />Storm Drain --Merced Street to Williams Street Project <br />Assessors Parcel Nos. 79A-338-1-31, -32 & -33 (Pors.), <br />79A-338-1-29 &_ -30 (Pors.) <br />IT IS RESOLVED by the City of San Leandro, California, as follows: <br />WHEREAS, it is desirable and necessary for the City of San Leandro to <br />acquire certain real property, particularly described in Exhibits A-1, A-2, A-3 and A-4 <br />depicted on Exhibits B-1, B-2, B-3 and B-4 attached hereto and made a Dart hereof <br />by reference, in order to construct an underground storm drain pipe from Merced <br />Street to Williams Street, which is a Public Works project; <br />WHEREAS, the City of San Leandro is vested with the power of eminent <br />domain to acquire real property by virtue of Article 1, Section 19, of the Constitution <br />of the State of California, and Sections 1240.050,1240.110,1240.120, 1240.125, <br />1240.150, 1240.240, 1240.350,1240.410 and 1240.610 of the Code of Civil <br />Procedure of the State of California; and <br />WHEREAS, pursuant to the provisions of Section 1245.235 of the Code of <br />Civil Procedure of the State of California, notice has been duly given to all persons <br />whose property is to be acquired by eminent domain and whose names and addresses <br />
