IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 97 - 49 (1049P,276 %-2q9� <br />RESOLUTION APPROVING THE AMENDMENT TO THE <br />MAINTENANCE, OPERATION AND RECIPROCAL EASEMENT <br />AGREEMENT FOR 1371 EAST 14TH STREET AND 1330 WASHINGTON AVENUE <br />1. Sizzler Restaurants International, Inc., has sold its interest in the property at 1330 <br />Washington Avenue to Albert Fong, Amy Fong, Zhao K. Fong, and Ling Chi Wu Fong who will <br />operate the site as Buffet Fortuna restaurant, and the parties desire to memorialize this change. <br />2. Sizzler, Eureka Federal Savings of San Francisco, and the City of San Leandro had <br />originally executed a Maintenance, Operation and Reciprocal Easement Agreement C'MOREA") <br />on October 22, 1984, which provided for maintenance of the common areas by Sizzler. <br />3. The City now elects to assume the role of operator for maintenance and operations <br />under the terms of the MOREA, and the cost to each party for maintenance and operations of the <br />common areas has been calculated. <br />4. The Amendment to the Maintenance, Operation and Reciprocal Easement <br />Agreement incorporates these changes, and is attached hereto, and the City Council is familiar with <br />the contents thereof. <br />The City Council of the City of San Leandro does RESOLVE as follows: <br />The Amendment to the Maintenance, Operation and Reciprocal Easement Agreement is <br />hereby approved, and the City Manager is directed to execute the Amendment <br />
