1 <br />C. Emergency Clearance. In the event a. storm drain is clogged and <br />overflowing, or a street is blocked by spilled debris, and the <br />Association needs an immediate response, the Association shall <br />first contact a private provider to perform the emergency services. <br />Only if a private provider is not available, the Association may <br />request that the City provide emergency response. <br />The parties acknowledge that the City is under no obligation to <br />provide emergency response, and the City may determine, in its <br />sole and absolute discretion, whether to dispatch a crew to the <br />Subdivision to carry -out emergency work. <br />2. PAYMENT. The Association shall pay the City for services rendered <br />pursuant to this Agreement as follows: <br />A. Street Sweeping.. The Association shall pay the City One <br />Thousand Five Hundred Dollars ($1,500.00) annually for street <br />sweeping services. This payment shall be made by July 1 of each <br />year for the services to be rendered in the upcoming year. <br />B. Storm Drain Cleaning. The Association shall pay the City One <br />Thousand Dollars ($1,000.00) annually for storm drain cleaning. <br />This payment shall be made by July 1 of each year for the <br />services to be rendered in the upcoming year. <br />C. Emergency Cleaning. The Association shall pay the City the <br />City's actual costs for responding to a request for emergency <br />services. In addition, the Association shall also pay overhead <br />costs equal to one hundred percent (100%) of the total bill. The <br />City shall provide the Association with an invoice that gives a <br />detailed breakdown of the charges. It shall be the sole <br />responsibility of the Association to pay to the City all charges <br />incurred, and to seek reimbursement in the event a resident of <br />the Subdivision calls the City requesting emergency services. <br />3. RESOLUTION. The Board of Directors of the Association shall enact <br />a resolution accepting the terms, covenants, and conditions of this <br />Agreement.
