Tow Service <br />50.00 + <br />1.00 <br />Per $1,000 of <br />Gross Receipts" <br />SECTION 2. If for any reason the provisions of this Ordinance are <br />suspended or held invalid in whole or in part by a court of competent jurisdiction or <br />if the provisions of Section 1 hereof fail to become operative, then in such instance <br />the terms, conditions and provisions of Chapter 2 of Title II of the San Leandro <br />Municipal Code or applicable portion thereof in effect immediately prior to <br />November 6, 1995, shall become operative and effective. <br />SECTION 3. This Ordinance is hereby declared to be an urgency <br />ordinance and pursuant to San Leandro Municipal Code Section 1-1-345 (d) shall <br />take effect immediatelv because it is related to business license classifications and fees <br />for the usual and current expenses of the City. Notwithstanding this Section 3, the <br />provisions of Section 1 hereof shall be operative when and if approved by the <br />electorate in accordance with Article XIIIC of the California Constitution. The fees <br />imposed on the issuance of business licenses or on business classifications shall be as <br />set forth in Section 1 hereof from and after the operative date of Section 1 and <br />Section 1 shall have no retroactive application. Any action to challenge the fees <br />imposed by this Ordinance shall be brought pursuant to Government Code Section <br />50077.5. The City Clerk is directed to publish to title and post a complete copy <br />hereof within five days following adoption. <br />3 <br />
