Section 1.10 Force Maieure <br />Earthquake, fire or other casualty, flood, landslide, epidemic, unusual adverse <br />weather not reasonably anticipatable, "acts of God," war, civil disturbance, court ordered <br />injunction, intervention by civil or military authorities or government, strikes, lockouts, <br />boycotts, or other labor disputes, to the extent any of the foregoing are beyond the <br />reasonable control of either Landlord or Tenant, which cause such party to be delayed or <br />hindered in or prevented from the performance of any covenant or obligation under this <br />Lease other than the payment of money. <br />Section 1.11 Government Requirement <br />Any law, regulation, rule or order of any governmental entity affecting this Lease or <br />the development, construction or operation of the Premises, the Improvements and/or <br />Tenant's operation of the Facility. <br />Section 1.12 Gross Revenues <br />All revenues, whether in the form of cash, credit or exchange for other goods or <br />services, received by or for the benefit of Tenant or anyone acting under or through Tenant <br />(including, without limitation, sublessees, licensees and concessionaires) derived from or in <br />connection with the use or operation of the Facility. Gross Revenues shall include, without <br />limitation, revenues derived from (i) the rental or use of hotel rooms or other lodging <br />facilities, (ii) the rental or use of meeting rooms, banquet rooms, reception rooms or other <br />conference facilities (including, without limitation, reservation fees, administrative fees and <br />retained or applied deposits, provided that such amounts shall not be included in Gross <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT PAGE 4 <br />2574001\313983.8 <br />
