reservation, and shall be held only at nonpeak times. Any balance of time remaining at the <br />end of each year shall not carry forward to the succeeding year. <br />Section 5.2.4. Public Access <br />In addition to use of the Nonexclusive Areas by Landlord and community nonprofit <br />groups, Tenant shall provide the public with access to those portions of the Premises and <br />Improvements designated on Exhibit E attached hereto. <br />Such public use and enjoyment shall be subject to Tenant's right to establish and <br />enforce reasonable regulations, areas of restricted access, and reasonable restrictions on use <br />(such as, but not limited to, skateboarding, camping, sleeping, picnicking, ball playing, <br />sunbathing, playing musical instruments, and the like). If necessary, Landlord will adopt and <br />use reasonable efforts to enforce reasonable rules and regulation governing public use and <br />conduct at the San Leandro Marina and in the vicinity of the Premises to ensure Tenant's <br />quiet enjoyment of the Premises. Except for access rights expressly granted to Landlord, <br />bona fide community non-profit groups and the public pursuant to the terms hereof, no other <br />parties shall have express or implied rights to the Premises and Tenant shall have quiet use <br />and enjoyment thereof. Any provision of this Lease to the contrary notwithstanding, Tenant <br />agrees that at all times during the Term of this Lease, the roadway identified on Exhibit A <br />as North Dike Road shall be and remain a public street, and Tenant shall not limit or <br />interfere with public access on and over North Dike Road, except for such temporary, <br />limited interference as may reasonably be required during Tenant's construction of the <br />Improvements, provided that through access is at all times available notwithstanding such <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT PAGE 29 <br />2574001\313983.8 <br />
