period of its decision either to grant or deny its approval, Landlord shall be deemed to have granted its approval. This Article XXIII shall have no application to rentals of guest rooms or conference rooms within the Facility, or to the granting of concessions or licenses in the normal course of operation of a Facility of this Type, provided that Tenant shall grant any such concession, license or sublease in accordance with the Standard of Operation and the term of any such concession or license shall not extend beyond the Term hereof, and provided further that any such concession or license agreement shall be expressly subordinate to this Lease and shall recognize Landlord's option to terminate the same in the event this Lease is terminated. Section 23.2 Limitation on Transfer of Interest in Tenant If Tenant is a corporation, a limited liability company, a partnership or a joint venture, the transfer, assignment or hypothecation (except for a hypothecation in connection with a loan transaction of the type contemplated by Article XXIV hereof) of a controlling interest (as "controlling" is defined in Section 5.3) in Tenant, any parent of Tenant, any Constituent Member of Tenant who holds a controlling interest in Tenant, or any parent of a Constituent Member of Tenant who holds a controlling interest in Tenant (collectively, "Control Parties") shall be deemed an assignment within the meaning of this Article XXIII.
