C Developer Responsibilities <br />As a condition precedent to the Agency obligation to sell and convey the Property to the Developer, <br />the Developer shall: <br />Submit to the Agency a Final Development Plan and Preliminary Pro Forma for the <br />development of the Property, substantially consistent with the Development <br />Concept Plan and the Redevelopment Plan. <br />2. Submit to the Agency construction plans based upon the Final Development Plan. <br />Submit to the Agency plans for financing the acquisition of the Property and <br />construction of the improvements, along with a Project Budget. <br />4. Obtain all Agency and City approvals of all design plans and construction permits <br />for the Project, including building permits. <br />Pay all customary and reasonable fees and charges of the City of San Leandro in <br />connection with the processing and consideration of the City permits and <br />approvals required for the Project. <br />h. Prior to conveyance of the Property, the Developer will have signed lease <br />agreements for the grocery store, drug store, video store, and at least one fine.. <br />dining restaurant tenant. <br />Presuming that the above conditions are met, and subject to the specific terms and conditions stated in <br />the Agreement, the Developer shall: <br />1. Purchase the Developer Parcel from the Agency for the agreed upon price in the <br />DDA, with the Developer required to spend an additional $1,000,000 for <br />architectural and site upgrades, as detailed above, pursuant to the terms and <br />conditions of the DDA <br />2. Develop and constrict all improvements on the Property in accordance with the <br />approved Construction Plans and within the time frame specified in the Agreement. <br />3.
