DEFINITIONS <br />The following definitions relate to such terms found in the entire Agreement, <br />including, without limitation, all Exhibits hereto. <br />A. "Agency" - Redevelopment Agency of the City of San Leandro <br />B. "City" - City of San Leandro <br />C. "Date of Operation" - The date on which the anchor grocery store tenant <br />opens for business. <br />D. "Date of Substantial Completion" - The date when (i) Certificates of <br />Occupancy have been issued by the City for 90% of the leasable area and (ii) <br />final inspection approval of the building shell permits has been granted. <br />E. "Developer" - Creelcside Center Associates, a California Corporation <br />F. "Development Concept Plan" - The plan submitted to the Agency by <br />Developer on June 30, 1997, and incorporated herein as Exhibit B. <br />G. "Redevelopment Plan" - The Plaza 2 Redevelopment Plan adopted by the City <br />Council of the City of San Leandro, as amended. <br />AGREED: <br />PART ONE: PROJECT <br />Article One: DEVELOPER'S PRE -DISPOSITION REQUIREMENTS <br />1.01 Conditions Precedent. <br />As a condition precedent to the Agency's obligation to sell and convey to <br />Developer the portions of the Property acquired by the Agency and Developer's <br />commencement of construction, the conditions set forth in this Article One must be <br />met no later than one hundred eighty (180) days after the execution of this <br />Agreement, unless such time limit is extended by the Agency or at the discretion of its <br />Executive Director. <br />Disposition and Development.
