Any material change, modification, revision or alteration of the approved Final <br />Development Plan shall be submitted for approval by the Agency; if not so approved, <br />the approved Final Development Plan shall continue to control. Any proposed <br />material change, modification, revision or alteration shall be approved or disapproved <br />by the Agency within fifteen (15) days of submittal unless the change is major and <br />requires review by the Agency Board, in which case within sixty (60) days of <br />submittal. <br />1.04 Preliminary Tenant/Leasing Plan <br />At the same time as the Developer submits to the Agency a Final Development <br />Plan for the Improvements, the Developer shall submit a Preliminary Tenant/Leasing <br />Plan. The Plan shall list the names of proposed tenants for 90 percent of the leasable <br />space. The Agency shall approve or disapprove the Preliminary Tenant/Leasing Plan <br />within 30 days of submittal to the Agency. <br />1.05 Preliminary Project Pro Forma <br />At the same time as the Developer submits to the Agency a Final Development <br />Plan for the Improvements, as set forth in Section 1.03 above, the Developer shall <br />submit a Preliminary Project Pro Forma. The Project Pro Forma shall include all the <br />information listed in the sample Pro Forma contained in Exhibit C. The Preliminary <br />Project Pro Forma shall demonstrate how the additional $1,000,000 to be spent on' <br />site and architectural upgrades shall be allocated. The following costs shall be <br />counted as additional project upgrades: <br />a. The incremental costs for site work, creek improvements, and plaza <br />above $3.00 per square foot of land area; and <br />b. The incremental cost for architectural upgrades to structures above <br />S50.00 per square foot of building shell costs, excluding tenant <br />improvements and site work. <br />In addition, to qualify for the $1,000,000 credit for architectural <br />improvements, the Developer must demonstrate that at least $150.00 per square foot <br />is being spent by Developer and/or tenant on hard costs (shell costs and tenant <br />improvements) for the fine dining restaurant. <br />Disposition and Development Page 4 <br />Agreement (Creekside Center) <br />7/23/97, 8/5/97, 8/11/97, 8/12/97 <br />
