23. Recordation of Abstract. Concurrently with the execution of this Agreement, Subdivider <br />has executed and has caused to be acknowledged an abstract of this Agreement. Subdivider agrees <br />City may record said abstract in the Official Records of Alameda County. Upon initial approval and/or <br />initial acceptance of the required improvements by the City Council, City agrees to record a Notice of <br />Completion in the Official Records of Alameda County. <br />City. <br />24. Assignment. This Agreement will not be assigned without the prior written consent of <br />25. Additional Terms and Conditions. This Agreement is subject to the following additional <br />terms and conditions, including all applicable conditions of approval for the General and Precise <br />Development Plans for PD-91-3, for the Vesting Tentative Map for Tract 6665; and for the Roberts <br />Landing Rezone Initiative (Measure D). <br />(a) Reference: Paragraph 14. Maintenance Security. Subdivider shall furnish the City a <br />maintenance and repair security in a form acceptable to the City Engineer in the <br />amount of FIFTY FIVE THOUSAND FOUR HUNDRED DOLLARS ($55,400.00) <br />to guarantee that all areas to be improved are free from defect for the periods described <br />below: <br />1.
