paid directly to the taxing authority, (ii) gratuities for food and beverage service consistent with <br />industry standards (but not exceeding 15% of food and beverage charges), (iii) sums (including <br />insurance proceeds) received in settlement of claims for loss or damage other than business <br />interruption or rental loss insurance, (iv) consideration for the sale of furniture, fixtures and <br />equipment, (v) accounts receivable which have been determined to be uncollectible for federal <br />income tax purposes, (vi) returns of merchandise and refunds in fact made by Tenant upon <br />transactions included in Gross Revenues, not exceeding the selling price of the merchandise <br />returned, (vii) interest earned on operating and reserve funds; and (viii) charges or fees paid to <br />credit card companies or issuers in connection with credit card transactions. <br />Section 1.14 Hazardous Materials <br />Each and every waste, substance, material, pollutant, or contaminant now or at any time <br />in the future deemed hazardous under any Environmental Law, including without limitation any <br />hazardous substance, hazardous waste, hazardous material, petroleum hydrocarbon (including <br />crude oil or any fraction thereof), asbestos containing building material, radioactive material or <br />device, or radon or methane gas. <br />Section 1.15 Improvements <br />All buildings, structures and improvements constructed, or to be constructed, on or in the <br />vicinity of the Site by or on behalf of Tenant or Landlord under the terms of the Development <br />Agreement or otherwise, whether at or before the commencement of the Term or later.
