Subdivider agrees City may record said abstract in the Official Records of Alameda County. Upon <br />initial approval and/or initial acceptance of the required improvements by the City Council, City <br />agrees to record a Notice of Completion in the Official Records of Alameda County. <br />City. <br />24. Assignment. This Agreement will not be assigned without the prior written consent of <br />25. Additional Terms and Conditions. This Agreement is subject to the following <br />additional terms and conditions, if any: <br />(a) Reference: Paragraph 14. Maintenance Security. Concurrently with the execution <br />hereof Subdivider shall furnish and/or maintain with the City a maintenance and <br />repair security in a form acceptable to the City Engineer in the amount of FIFTY <br />THOUSAND AND FOUR HUNDRED EIGHTY-FIVE DOLLARS ($50,485.00) <br />to guarantee that all areas to be improved are free from defect for the periods <br />described below: <br />1. THIRTY-FIVE THOUSAND AND FOUR HUNDRED EIGHTY-FIVE <br />DOLLARS ($35,485.00) for the one year warranty period after initial <br />acceptance of entire work by the City as stated in Paragraph 14., hereof, and; <br />2. FIFTEEN THOUSAND DOLLARS ($15,900.00) as a cash security deposit <br />to guarantee the adequate function of the erosion control measures shown on <br />the plans and specifications for the improvement of said subdivision. Said <br />erosion control measures are for the benefit of all five (5) phases of the <br />Marina Vista project as approved under Vesting Tentative Map 6379.
