That on or about the 6th day of November 2000, the City of San Leandro, a municipal corporation of the <br />State of California, having offices at 835 East 14th Street, San Leandro, California, did enter into a certain <br />contract with INDEMNITY COMPANY OF CALIFORNIA, CMDC, Incorporated, as contractor, for a <br />certain work of improvement: To wit, HALCYON PARK RESTROOM REPLACEMENT, PROJECT <br />NO.99-210-69-110. <br />2. That the name of the sureties upon the bond of the Contractor for said work of improvement are as follows: <br />Indemnity Company of California. Said contract was completed by Indemnity Company of California <br />under terms of the bond due to failure of CMDC, Incorporated, to complete the contract. <br />3. That said work of improvement was accepted by the City Council of the City of San Leandro as completed <br />on the 15th day of July 2002. <br />4. The nature of the interest or estate of the City of San Leandro as owner of the Halcyon Park Restroom <br />Replacement, Project No. 99-210-69-110, is that of fee simple title in certain land designated as 1245 147th <br />Avenue, San Leandro, California, as well as ownership of improvements thereon. <br />I certify under penalty of perjury that the foregoing is true and correct.
