March 13, 1956
To: Wesley McClure, City Manager
From: Arthur M. Carden, City Attorney
Re: Library Property
A violation of the conditions contained in the Deed from T. P.
Cary covering the present library site could result in an injunction
being issued against the City using this property for other than
a library building site.
However, I have discussed this with Mrs. Cochrell, one of the
surviving desceridants of T. P. Cary. She sees no objection to grant-
ing us permission to use the property for library purposes, but not
necessarily as a library building site. In order to have such a
document properly executed, it will be necessary to have a rundown
on T. P. Cary's estate.
understand his property was left to his children who are now
de-d., but most of whom left heirs. It would be necessary to have all
living heirs execute such document.
Very truly yours,
Arthur M. Carden,
City Attorney
AMC: sa
