#192715E <br />-2- <br />NOTE 1: In Flap Book 18, page 79, is a map <br />entitled, "Elsie Avenue Opening", etc., filed December 4, 1929, <br />showing said property to be taken for the opening of said avenue. <br />NOTE 2: There is noted an action No. 1154150 <br />entitled, City of San Leandro, a municipal corporation, <br />plaintiff, vs. James Cantwell, as executor of the estate of <br />Ellen Goodman, deceased, Minnie A. Parker, Geo. J. Helms, <br />Reubena J. Helms, Luiz G. Faria, Eva G. Faria, Doe One, Doe <br />Two, etc., defendants, pending in the Superior Court of the <br />State of California, in and for the County of Alameda, wherein <br />the complaint on file prays that certain real property may be <br />condemned for.the opening and extending of Elsie Avenue from <br />the Western termination of said avenue, as the same now exists, <br />to the Northeasterly line of East Fourteenth Street. The <br />herein named vestee is not named as a defendant in said action <br />and the property under examination is not described in said <br />complaint. Attached thereto is a copy of Resolution of <br />Intention No. 1823 N.S. of the Council of the City of San <br />Leandro, wherein the property under examination is described <br />as being necessary to be condemned for the opening and extend- <br />ing of said avenue. Said action has been dismissed as to the <br />defendant James Cantwell, as executor, etc. <br />NOTE 3: There is noted a certain lease, dated <br />May 1, 1932, made by Hugh J. Cosbie, Lessor, to H. J. Rapella, <br />Lessee, of "that certain four room dwelling house and its appurt- <br />enances and the lot upon which said house stands having a <br />frontage of 43 feet on Maud Ave. and a depth of approximately <br />320 feet" for the term of three years from May 1, 1932; recorded <br />November 17, 1932 in Liber 2855 of Official Records, at page <br />442. <br />Said lease provides that the lessee, provided <br />he has complied with all the terms of said lease,shall have the <br />exclusive option to purchase said property, said option to run <br />and be operative during the first two years of said lease. <br />From the records it cannot be determined if <br />said option has been exercised. <br />Oakland, Alameda Co. tial.
