<br />I, the undersigned HENRY ROOT, a single man, of the
<br />City and County of San Francisco, State of California:
<br />DO hereby grant, subject tot he conditions, limitations
<br />and reservations hereinafter contained, unto the City of San
<br />Leandro, a municipal corporation,
<br />ALL that certain real property situate in the City of
<br />San Leandro, County of Alameda, State of California, and des- '
<br />cribed as follows, to wit: J Z�
<br />ALL of Lots Lumbered Forty-four (WO Forty-five (lid)
<br />and Forty-six (46) as said lots are laid down and delineated
<br />upon that certain :"ap entitled "i,'a_p of San Antonio Court, San
<br />Leandro, California 1913" filed August 9th 1913 in the office of
<br />the County Recorder of the County of Alameda.
<br />THIS CONVEYANCE is intended to be, and is, a gift of
<br />said land to the City of San Leandro for a public purpose, to -wit:
<br />a park or Public playground.
<br />PROVIDED that said park shall be named and always called
<br />the "IIENRY ROOT QTJA DRAIV GLE" .
<br />PROVIDED PITRTHER, that it shall be kept and maintaned
<br />as a park or public playground; that no buildings, fences or
<br />other im,Drovernents shall be made ore rected or permitted to be
<br />made or erected upon or about said land except such as are to
<br />be and shall be used exclusively for the Purposes of a public
<br />park or playground, and that no part of said land or any improve-
<br />ment, building or fence surrounding or upon the same or appurtenant
<br />thereto shall be used or permitted to be used for signs, sign -boards
<br />or other advertising means or matter.
<br />PROVIDED FTiRTTIER, that said "HENRY ROOT I TTATRATiCLE" con-
<br />sisting of the land hereby conveyed and the land heretofore con-
<br />veyed by said Henry moot to said Cit-V of San Leandro for the same
<br />,cur pose, shall be immediately improved b-; said City of San Leandro.
<br />PROVIDED FLIRT —IR, and it is hereby understood and a( -reed
<br />between the parties hereto that in the event any of said con-
<br />ditions shall be broken or said land or appurtenances used for
<br />any other purpos; than that above specified, then and in that event,
<br />said land, premises and appurtenances together with all improve-
<br />ments thereon shall revert to said party of the first part his
<br />heirs, administrators or assigns.
<br />IN WITNESS WHEREOF, I have hereunto set my hand this 1st
