lArO'l D E E D I. the undersigned HENRY ROOT, a single man, of the City and County of San Franci.sc0, State of California, Do hereby grant , subject to the conditions, limitations and reservations hereinafter contained, unto the CITY OF SAY LRAITDRO, a municipal corporation, All that certain real property situate in the City of San Leandro, County of Alameda, State of California, and described as follows, to -wit: All of Lots Numbered Forty-four (44), Forty-five (45), and Forty-six (46), as said lots are laid down and delineated upon that certain Map entitled, "dap of San Antonio Court, San Leandro, California 1913" -- filed August 9th 1913 in the office of the County Recorder of the County of Alameda. THIS COI;4 MANCE is intended to be, and is, a gift of said land to the City of San Leandro for a public purpose, to -wit: a park or a public playground. PROVIDED that said park shall be named and always called the "HENRY ROOT QUADEANGLE". PROVIDED FURT?R, that it shall be kept and maintained as a park or public playground; that no buildings, fences or other improvements shall be made or erected or permitted to be made or erected upon or about said land except such as are to be and shall be used exclusively for the purposes of a public park or playground, and that no part of said land or any improvement , building or fence surrounding or -ifon the same or appurtenant thereto shall be used or permitted to be used for signs, sign- boards or other advertising means or matter. PROVIDED FURTHER, that said "HENRY ROOT QUADRAT?GLE", consisting of the land hereby conveyed and the land heretofore conveyed by said Henry Root to said City of San Leandro for the same purpose, shall be i=.ediately improved by said City of San Leandro. PROVIDED FURTHER, and it is hereby understood and agreed between the parties hereto that in the event any of said con- ditions shall be broken or said land or appurtenances used for any other purpose than that above specified, then and in that event, said land, premises and appurtenances together with all improve- ments thereon shall revert to said party of the first part, his heirs, administrators or assigns.
