D E E D <br />We, the undersigned, P. LAVAGETTO and CELESTINA LAITAGETTO <br />(his wife), of tho City of Alameda, County of Alameda, State of <br />.'!„ <br />California, do hereby grant unto CITY OF SAN LEANDRO, a municipal <br />corporation, a perpetual easement and right of way over, upon, 6 <br />through and along the following described real property in the / <br />City of San Leandro, County of Alameda, Stz to of California, to <br />wi t2 <br />BEGINNING at the intersection of the Northeasterly line of <br />the right of way belonging to the Southern. Pacific Railroad Company, <br />in the said City of San Leandro, with the Northerly boundary line of <br />the land now or formerly owned by the Estate of Eleanor J. Haney, <br />deceased, end running thence along said boundary line North 76` 151 <br />East 22.86 feet; thence South 420 43' East 1150,10 feet to the <br />Westerly boundary line of the land now or formerly owned by Eugenia <br />da Gloria Santos; thence along said boundary line South 80 55' <br />West 25,50 feet to its intersection with the Northeasterly line of <br />the right of way belonging to the Southern Pacific Railroad Company, <br />end thence along the said line of said right of way North 4.20 43' <br />1Fest, 1177 feet to the place of begiruiing. <br />For the purpose of laying, cor_structing, maintaining and <br />operatir_g a sewer, together with the necessary man holes and flush- <br />tarks, together with the right to enter upon said right of way at <br />all reasonable times for the necessary management and repair of <br />said sewer. <br />Proviued, however, that the grantors hereby reservo to <br />themselves, their heirs and assigns, and this conveyance is accepted <br />by said grantee upon the express condition that the said grantors, <br />their heirs and assigns shall have the right to connect with said <br />sewer hereafter to be constructed on said right of way, any <br />dwelling house hereafter erected on the land of the grantors abutting <br />on said right of way anu hereinafter described, without the payment <br />of any charge therefor. <br />Provided, further, that this Deed is accepted by said grantee <br />upon the express condition that the City of San Leandro will, out <br />of its general fund, pay any assessment that may be levied upon <br />the lands of the said P. Lavagetto end wife through which said right <br />of way is granted, and particularly described in said Deed, for <br />the construction of a sewer on Peralta Avenue and over the said <br />Right of Way. <br />The land of the grantors abutting on said right of way and <br />hereinbefore referred to is situate in the City of San Leandro,$ <br />County of Alameda, btate of California,, and described as follows, to <br />(1) <br />
